RUN B RUN app terms of use

1. Who we are

RUN B RUN is provided by JTV BV, Max Euwesingel 19, 2406 LR Alphen aan den Rijn, the Netherlands (Chamber of Commerce no. 42052740). In these terms, 'we' and 'us' mean JTV BV and 'you' means the user of the app. Contact: info@runbrun.com.

2. Who can use RUN B RUN

You must be at least 16 years old to use RUN B RUN. You use the app for yourself and not for commercial purposes.

3. The app

RUN B RUN helps you record your runs, track your progress and, if you want, run with friends and use AI coaching. The app is currently free. We update RUN B RUN regularly and may add, change or discontinue features. We do our best to keep the app working well and securely, but we cannot guarantee it will always be available or error-free, for example during maintenance, outages or poor GPS reception. If paid features are ever introduced, you will see the price clearly in advance and choose for yourself.

4. Your account

Some features, such as cloud storage and Social, require an account. Use accurate details, keep your sign-in details secret and do not let others use your account. You are responsible for what happens with your account. If you suspect misuse, email info@runbrun.com right away. You can delete your account at any time via Account → Privacy & Account → Delete account.

5. Health and safety

RUN B RUN is a running tool, not a medical device. Please keep the following in mind:

• RUN LEVEL, scores, calories and training advice are estimates based on your runs. They are not medical measurements or diagnoses.
• AI coaching is generated automatically and may contain mistakes. Use it as inspiration, not as professional advice.
• If you have doubts about your health, have symptoms or are returning to exercise after a long break, talk to a doctor first.
• Routes and route suggestions are aids. Check for yourself that a route is safe, accessible and permitted, and always follow traffic rules.
• While running, pay attention to your surroundings, not your screen. GPS distances and pace may be inaccurate.

6. Social and your content

If you use Social, you agree to follow the community rules in the app. We do not tolerate harassment, bullying, hateful, sexual or misleading content, spam or other objectionable content. You can report users and content and block users. An administrator reviews reports as quickly as possible, and in any case within 24 hours on working days. If the rules are broken, we may remove content and restrict, suspend or terminate an account.

Your content, such as your display name, runs and routes, remains yours. You only give us permission to store it and show it to the people you share it with, as far as needed to make RUN B RUN work. This permission ends when you delete the content or your account, except for copies others have already received, such as a shared route.

7. What is not allowed

When using RUN B RUN, you may not:

• break the law or infringe the rights of others;
• impersonate someone else or create fake accounts;
• try to find out someone else's location or data, for example via Run & Meet or share codes;
• fake runs, scores or results to win challenges or duels;
• attack, overload or bypass the app, servers or security, or evade usage limits;
• automatically collect data from the app or other users;
• copy, sell or commercially use the app without our permission, except as expressly permitted by law.

8. Intellectual property

The app, the RUN B RUN name, logo, design, texts, voices and software belong to JTV BV or our licensors. You receive a personal, non-exclusive and non-transferable right to use the app under these terms. Open-source components are covered by their own licences, which you can find in the app under Account → Legal → Licences.

9. Liability

You use RUN B RUN at your own risk. To the extent permitted by law, we are not liable for damage resulting from using the app or from it being unavailable. This includes injury during exercise, loss of data and decisions based on estimates, routes or AI coaching. If you worry about losing your runs, use an account with cloud storage or export your data. Nothing in these terms limits our liability for intent or gross negligence, or your consumer rights that cannot be limited by law.

10. Stopping and termination

You can stop using RUN B RUN and delete your account at any time. We may restrict, suspend or terminate your account if you break these terms or the community rules, if the law requires it, or if needed to protect other users or the service. Where possible, we will tell you why in advance. If we discontinue RUN B RUN entirely, we will announce it in good time so you can export your data.

11. App Store and Google Play

If you download RUN B RUN from the App Store or Google Play, Apple's or Google's terms also apply. For the iOS app, the following also applies:

• these terms are an agreement between you and JTV BV, not Apple; Apple is not responsible for the app or its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple; to the extent permitted by law, Apple has no other warranty obligation;
• Apple is not responsible for any claims relating to the app, such as product liability, failure to comply with legal or regulatory requirements, consumer protection or third-party intellectual property infringement;
• you confirm that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Changes

We may update these terms, for example when the app or the law changes. We will let you know about important changes in the app in advance. If you keep using RUN B RUN after that, the new terms apply. If you do not agree, you can stop and delete your account.

13. Governing law and disputes

These terms are governed by Dutch law. As a consumer, you keep the protection of the mandatory rules of the country where you live. If you have a complaint, please email info@runbrun.com first and we will try to resolve it together. If that does not work, you can go to the competent court.
